يتلخص البحث حول حل مشكلة من المشاكل المعاصرة والمستجدة والتي لم يذكرها الفقهاء القدامى ومنها بعض البيوع الجديدة كالبيع القصير وبيع الأسهم وتعريفهما وبيان حكمهما من حيث الحِلّ والحُرمة. أما البيع بالتقسيط فقد أجازه أكثر الفقهاء لحاجة الناس اليه إذ يستطيع الإنسان أن يدفع مبلغا معينا محدودا في كل شهر لكي يضمن حاجة من حوائج البيت ولكن بشرط أن لا يُدخل بيعتين في بيعة، ومن العقود التي ذكرناها في هذا البحث ثمنها عقد الاستصناع الذي يشبه السلم إلا أنه بيع معدوم ،كمن يطلب تصنيع عدد من الكراسي من الصانع ويدفع ثمنها مقدما وهكذا، فنستطيع القول بأن البحث تضمن عقودا مستجدة ظهرت مع حاجة الناس إليها.

 
Abstract
The research summarizes on solving a problem of the contemporary and emerging problem that old jurists did not mention، including some new sales such as short selling، selling shares، and defining them، and explaining their ruling in terms of permissible and forbidden. Most jurists authorized selling in installments because people need it، so a person can pay a certain amount of money every month to ensure one of his household needs، but on the condition that he does not enter two sales in one sale، and one of the contracts that we mentioned in this research is the (Istisna'a contract) contract of Manufacture، which is a rare or a non-existent sale، for example when somebody requests the manufacture of a number of chairs from the manufacturer and pays for it in advance، and thus we can say that the research included new contracts that looked with the need of people for them.
