ملخص:
تعدّ الصفقات العمومية آلية أساسية في تنفيذ برامج التنمية الشاملة في الدولة، التي ترصد لتجسيدها ميدانيا أموال ضخمة، وموارد بشرية مهمة، وفي دول العالم خاصة المتخلفة منها، أصبحت تلك الصفقات مجالا لتفشي ظاهرة الفساد، ويمكن الإشارة على نحو واضح ومتنام إلى الفساد الإداري، والإثراء غير المشروع للمسؤولين والوسطاء، وكذا أعوان الرقابة والمتابعة، من خلال الرشاوي والامتيازات غير المستحقة، بما يفوّت على الدولة إيرادات مهمة، ويرفع مستويات الخطر والإهمال وعدم احترام المعايير المطلوبة، كما يساهم في ضياع حقوق كان ينبغي حمايتها، لو جرى التزام أطر الشفافية والنزاهة في مجال إبرام وتنفيذ الصفقات العمومية
لقد دفع اتساع حدة الفساد في الصفقات العمومية-خاصة من جهة تواطؤ وفساد المسؤولين العمومين- بالمشرع الجزائري إلى التصدي لهذه الجرائم ، من خلال استحداث أساليب جديدة أكثر فعالية، تضاف إلى الاساليب المدرجة في ظل قانون الإجراءات الجزائية، واصطلح على تسميتها بأساليب التحري الخاصة، وذلك بموجب قانون الوقاية من الفساد ومكافحته، وهي أساليب قمعية تسمح وتسهّل لضباط الشرطة القضائية عملية الكشف عن جرائم الصفقة العمومية، وإعطاء حرية أكبر للضبطية القضائية للكشف عن هذه الجرائم ومعاقبة مرتكبيها، ومن بين هذه الاساليب ما يسمى بالتسليم المراقب الذي أثبت تطبيقه في عديد الدول كفاءة عالية في ضبط الممارسات التجارية والصفقات العمومية، وأوجد انضباطا أكثر في الإجراءات والتحويلات المالية وحسن الإنجاز، وذلك توقيا للإجراءات العقابية.

Abstract
Public deals are an essential mechanism in implementing total development programs in the country, which cost large sums of money and important human resources.Many countries in the world, especially underdeveloped states, these deals have become an area for the spread of the phenomenon of corruption through the signature and implementation of public deals. It is possible to refer to administrative corruption in a clear and increasing manner, and the illicit enrichment of officials and intermediaries, as well as the agents of control and follow-up through bribes and undue privileges, including loss of important revenues for the state, raising the levels of risk, neglect and failure to respect the required standards, and also contributing to the loss of rights that should have been protected if the frameworks of transparency and integrity were committed in the field of concluding and executing public deals.
The expansion of corruption in public deals - especially from the side of collusion and corruption of public officials - has pushed the Algerian legislature to confront these crimes by developing new, more effective methods, which are addedare added to the methods listed under the Criminal Procedures Law, and it has been termed to be called Special Investigative Methods, according to the Law on Corruption Confronting and prevention from it, repressive methods that allow and facilitate the judicial police officers to uncover public deal crimes, and give greater freedom to judicial control to uncover these crimes and punish their perpetrators. Among these methods is the so-called controlled delivery, whose application in many countries has proven highly efficient in controlling commercial practices and public deals, and has created more discipline in financial procedures and transfers and good performance, in order to avoid punitive measures.
